Active or inactive members of the Employees' Retirement System, Teachers' Retirement System, or Judicial Retirement Fund who have accrued benefits shall forfeit all retirement benefits upon guilty plea, no contest plea, or final conviction of a felony offense related to their public position.

Forfeiting members are entitled to a refund of their retirement contributions plus applicable interest as declared by a presiding judge in a United States federal, Alabama, or other state court.

Retired members receiving benefits shall have their retirement benefits suspended upon such a plea or conviction; if they have not received benefits exceeding their contributions and interest, they receive a refund of remaining contributions and interest.

Officers and employees of the three retirement systems are granted immunity from civil or criminal liability for any actions taken pursuant to this act.

The act becomes effective immediately upon passage and approval by the Governor or otherwise becoming law.
