SB225 Summary

• Establishes the crime of "offering a false instrument for recording" as a Class A misdemeanor when a person knowingly presents a written instrument containing material false statements relating to real or personal property to a public office with intent to defraud.

• Creates the crime of "falsely removing an instrument from recording" as a Class C felony when a public servant attempts to remove a valid written instrument from recording.

• Establishes the crime of "offering a false instrument for recording against a public servant" as a Class C felony when a person offers a false instrument relating to a public servant's property or contractual relationship with intent to defraud, intimidate, harass, or impede the servant's duties.

• Allows requests to remove false instruments filed against a public servant to be transferred to circuit court and expedited; if not heard within 45 days, the request may be heard by a magistrate under Alabama Rules of Civil Procedure.

• Becomes effective immediately upon passage and approval by the Governor.
