SB240 Summary

• Amends Sections 12-15-115, 12-15-117, and 38-10-7 of the Alabama Code to clarify and expand juvenile court jurisdiction over civil proceedings involving children.

• Provides that juvenile courts have jurisdiction over adoption proceedings when transferred from probate court, and jurisdiction to establish, modify, or enforce support, visitation, or custody when the court has previously established paternity or maternity.

• Grants juvenile courts jurisdiction to modify or enforce child and spousal support in Title IV-D Social Security Act cases and allows juvenile courts to retain jurisdiction to enforce or modify any prior orders issued by the court in cases within their jurisdiction regardless of the individual's age.

• Allows any state court that determines parentage or establishes, modifies, or enforces support to retain jurisdiction to enforce or modify previous orders issued by that court unless otherwise provided by law.

• Applies to all cases filed on or after the effective date and becomes effective immediately upon passage and gubernatorial approval.
