SB29 Summary

• Amends Section 24-1-28 of the Code of Alabama 1975 to require municipal public housing authorities to obtain approval from the municipal council before exercising the power of eminent domain.

• Authorizes the authority to acquire real or personal property by eminent domain only after adopting a resolution declaring the acquisition is in the public interest and necessary for public use.

• Maintains existing protections preventing acquisition of property belonging to cities, governments, or public utility corporations without their consent or approval from the Public Service Commission.

• Eminent domain proceedings shall be conducted pursuant to the provisions of Title 18.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
