Amends Section 13A-12-27 of the Code of Alabama 1975 to increase the penalty for possession of a gambling device in furtherance of a business enterprise from a Class A misdemeanor to a Class C felony.

Possession of a gambling device remains a Class A misdemeanor under general circumstances, but becomes a Class C felony when possessed in furtherance of a business enterprise.

The bill is excluded from Amendment 621 constitutional requirements regarding local expenditures because it defines a new crime or amends the definition of an existing crime.

The act becomes effective on the first day of the third month following passage and approval by the Governor, or upon otherwise becoming law.
