SB306 Summary

• Limits liability of agritourism professionals for participant injuries or death caused by inherent risks of agritourism activities, including land conditions, animal behavior, equipment dangers, and participant negligence.

• Creates exceptions where agritourism professionals remain liable for: actual knowledge of non-obvious dangerous conditions not disclosed to participants, failure to properly train employees, or intentional/willful injury.

• Requires agritourism professionals to post warning notices and include warnings in written contracts with participants under certain conditions.

• Does not apply to paid participants (employees) and does not affect existing open and obvious danger doctrines.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
