SB307 Summary

• Creates the "Fair and Open Competition in Governmental Construction Act" to promote economical and nondiscriminatory administration of state and state-funded construction projects.

• Prohibits public agencies and construction managers from including terms in bid specifications or project agreements that require, prohibit, encourage, or discourage contractors from entering into or adhering to collective bargaining agreements.

• Prohibits public agencies from awarding grants, tax abatements, or tax credits conditioned upon requirements that recipients include union-related terms in construction contracts for subject property.

• Declares any prohibited union-related terms void and of no effect if included in public construction documents.

• Effective November 1, 2012, but does not apply to contracts executed before that date and does not prohibit private parties from voluntarily entering into collective bargaining agreements or interfere with National Labor Relations Act protections.
