SB324 Summary

• Amends Alabama's Good Samaritan Law (Section 6-5-332) to extend civil immunity protections to licensed psychologists, licensed professional counselors, and licensed social workers who provide emergency mental health treatment without compensation.

• Licensed mental health professionals are protected from civil liability when they gratuitously render emergency mental health treatment at the scene of an accident, casualty, or disaster, provided they act as a reasonably prudent person would under similar circumstances.

• Immunity extends to 90 days following declaration of an emergency for acts, services, or omissions provided in connection with emergency response activities.

• Protection does not apply if the mental health professional acts with gross negligence or provides services for compensation.

• Effective date is the first day of the third month following passage and approval by the Governor.
