SB328 Summary

• Amends Section 11-44G-2 of the Code of Alabama 1975 to exclude Class 7 and 8 municipalities with populations of 12,000 or more from its vacancy-filling procedures for the mayor's office.

• Establishes that municipalities with 12,000 or more inhabitants shall fill mayoral vacancies pursuant to Section 11-43-42(a), which provides that the council president shall succeed to the mayor's office.

• Maintains existing procedures for Class 7 and 8 municipalities with less than 12,000 inhabitants, allowing the city council to fill vacancies or, if unfilled within 60 days, allowing city council members to submit names to the Governor for appointment or triggering a special election after 90 days.

• Requires voter identification in any special elections, accepting Alabama driver's licenses or alternative forms such as passports, credit cards, government-issued identification, and welfare or Medicare cards.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
