SB331 Summary

• Prohibits business entities, property owners, and public or private employers from establishing policies against transporting or storing firearms and ammunition in privately owned motor vehicles when the firearm is kept from ordinary observation and the vehicle is operated or parked in a lawful location.

• Authorizes civil actions for persons injured or denied the opportunity to transport firearms, with court costs and attorney's fees awarded to prevailing plaintiffs.

• Requires reinstatement to the same or equivalent position, restoration of full fringe benefits and seniority rights, and compensation for lost wages and benefits for employees discharged in violation of these protections, with a 45-day deadline for employer compliance before civil action can be filed.

• Provides limited immunity to employers and property owners for damages or injuries resulting from another person's actions involving a transported firearm, unless the entity intentionally solicited or procured the injurious actions.

• Does not apply if the person is prohibited from firearm possession under state or federal law, or if the vehicle is located where firearms are expressly prohibited by federal law.
