SB362 Summary

• Mobile County shall conduct a referendum election at the 2012 general election on the composition of the Mobile County Commission with four options for voters to choose from.

• Question 1 asks voters whether to maintain the current three-member commission; Question 2 proposes five full-time members elected from single-member districts; Question 3 proposes five part-time members with total salary divided equally plus a county manager; Question 4 proposes seven part-time members with divided salary plus a county manager.

• If any question receives 50 percent plus one votes at the primary election, it shall be implemented; if not, the two questions receiving the most votes proceed to the general election, and the winning question at the general election is implemented.

• If Question 2 is selected, five full-time commissioners shall receive the same salary and benefits as prior commission members; if Questions 3 or 4 are selected, part-time commissioners shall share the total salary of three full-time commissioners equally and a county manager must be employed to administer day-to-day county operations.

• County manager qualifications include a bachelor's degree in public administration, political science, or business management and five to ten years of responsible administrative experience; the manager serves at the pleasure of the commission and requires 90 days written notice of termination.
