SB 365 Summary

• Establishes the Alabama School Flexibility Act of 2012 to authorize innovative schools and school systems in Alabama with flexibility from state laws, regulations, and policies.

• Allows the State Board of Education to enter school flexibility contracts with local school systems for programmatic and/or budgetary flexibility in exchange for academic and college/career readiness goals.

• Requires local school systems to submit a letter of intent, board resolution, document of assurance, innovation plan, and list of waivers sought; superintendent must have served minimum one year in district.

• Local school systems remain accountable to state and federal accountability requirements and cannot waive requirements imposed by federal law.

• Requires State Board of Education to promulgate rules establishing timelines for submission and approval, procedures for denial and resubmission, and authorization to revoke contracts for noncompliance or nonperformance.
