SB372 Summary

• Amends Amendment 555 to increase the threshold for requiring a statewide referendum on local constitutional amendments from any dissenting vote to at least 15 dissenting votes in the House of Representatives and at least 5 dissenting votes in the Senate.

• Local constitutional amendments affecting only one county or political subdivision can be adopted by majority vote of electors in that county or subdivision, but only if they receive fewer than the specified dissenting votes in the Legislature.

• Requires proposed amendments to first be approved by at least three-fifths vote of elected members in each house of the Legislature and by majority vote of the Local Constitutional Amendment Commission (composed of the Governor, Attorney General, Secretary of State, and legislative presiding officers).

• If dissenting votes meet or exceed the thresholds (15 in House or 5 in Senate), the amendment is automatically submitted as a statewide referendum under existing constitutional procedures.

• Ratifies all constitutional amendments previously adopted under Amendment No. 425 that received local voter approval.
