Authorizes the Comptroller to transmit funds from the Penny Trust Fund to the Department of Public Health upon application of the State Health Officer, with 50% for infant mortality/child health programs and 50% for indigent health care programs.

Authorizes the Comptroller to transmit funds to the State Board of Education upon application of the State Superintendent of Education for disease prevention programs in public schools, with grants requiring board approval.

Defines "earnings" as 90% of the prior fiscal year's earnings of the Penny Trust Fund and appropriates accumulated earnings from fiscal year 2001 forward sufficient to fund all approved applications and proposals.

Modifies the Board of Control of the Penny Trust Fund to include the Governor, State Treasurer, State Health Officer, State Superintendent of Education, and State Auditor.

Requires school systems receiving funds to use them only for disease prevention programs and prohibits use to replace or supplant existing funds from other sources; specifies board duties including reviewing proposals and developing investment policy.
