SB436 Summary

• Creates a new class of community development district (subsection (e)) in wet counties that do not authorize Sunday alcohol sales, located outside municipal corporate limits and police jurisdiction.

• New district type must include a restaurant with 120+ seating capacity, grocery-delicatessen, riding stables and trails, community information center, outdoor programming, and rural lifestyle demonstrations.

• Upon Board of Control approval, authorizes on-premises Sunday sales of alcoholic beverages by licensed persons within the new district, notwithstanding county restrictions on Sunday sales.

• Establishes filing requirements with probate judge including written owner consent, metes and bounds description, schematic layout, district name/address, and board designation; charges one-time $500 filing fee payable to county.

• Becomes effective immediately upon passage and gubernatorial approval.
