SB463 - Alabama Tourism Destination Attraction Incentive Act

• Establishes the Alabama Tourism Destination Attraction Incentive Act, allowing municipalities, counties, and public industrial authorities to grant abatements of ad valorem taxes and construction-related transaction taxes to private users of tourism destination attractions for up to 10 years.

• Defines "tourism destination attraction" as a commercial enterprise open to the public at least 120 days per year designed to attract visitors for cultural value, historical significance, natural/man-made beauty, or entertainment opportunities (includes museums, botanical gardens, amusement parks, convention hotels, water parks, and spectator venues).

• Enables tourism destination attractions to qualify for capital credits equal to up to 5 percent of capital costs annually over 20 years, subject to minimum capital investment thresholds of $20 million (non-favored areas) or $5 million (favored geographic areas).

• Requires approval of abatements by county or municipal governing body resolution and establishes employment requirements of at least 50 new jobs for non-favored areas or 20 jobs for favored geographic areas, with specified minimum wage requirements.

• Excludes gaming facilities and certain retail-focused establishments (shopping centers, movie theaters, bowling alleys, fitness centers) from receiving abatement benefits, though retail components may be included in capital costs of qualifying attractions.
