SB538 Summary

• Permits persons 21 years or older to produce home brewed beer, mead, cider, and table wine for personal use without taxes, fees, or licensing.

• Limits production to 15 gallons per quarter per residence with maximum 15 gallons stored on premises at any time; prohibits sale or removal except up to 10 gallons for licensed homebrew competitions.

• Prohibits persons convicted of felonies from home brewing and makes violations a Class B misdemeanor.

• Prohibits production in dry municipalities and dry counties; restricts production in non-wet municipalities; bans distilled liquors and use of distilled spirits in production.

• Adds definitions of mead (fermented honey and water beverage up to 18% alcohol) and cider (fermented apple juice beverage up to 8.5% alcohol) to Alabama Code Section 28-3-1.
