SB560 Summary

• Establishes the Alabama Behavior Analyst Licensing Board to license and regulate behavior analysts and assistant behavior analysts in the state, with board membership consisting of three licensed behavior analysts, one licensed assistant behavior analyst, and one consumer representative appointed by the Governor.

• Defines the practice of applied behavior analysis as design, implementation, and evaluation of instructional and environmental modifications based on scientific research and direct observation, explicitly excluding psychological testing, psychotherapy, cognitive therapy, and other specified treatment modalities.

• Requires licensed behavior analysts to be certified by the nationally accredited Behavior Analyst Certification Board, maintain good moral character, meet renewal requirements, and comply with professional ethical standards; licensed assistant behavior analysts must also work under supervision of a licensed behavior analyst.

• Prohibits unlicensed practice of applied behavior analysis and misrepresenting oneself as a licensed behavior analyst, with violations punishable by fines up to $250 and/or suspension or loss of license.

• Provides for reciprocal licensing of behavior analysts licensed in other states who are currently certified by the certifying board and have no disciplinary actions; board is subject to Alabama Sunset Law with termination date of October 1, 2015, and every four years thereafter unless continued.
