SB19 Summary

• Proposes a constitutional amendment to authorize the Alabama Legislature to enact general laws allowing for recall of elected state officials.

• Requires recall petitions to be filed with the Secretary of State and signed by electors equal to at least 25 percent of votes cast for the office in the last preceding election within 90 days.

• Permits recall elections to be initiated after the first year of an official's term on grounds of malfeasance, nonfeasance, lack of physical or mental fitness, incompetence, or violation of oath of office.

• Mandates the Secretary of State call a recall election for the sixth Tuesday following verification of sufficient signatures, with the incumbent continuing to perform duties until results are officially declared.

• Limits recall to one petition and election per officer per term and requires the candidate receiving the highest votes in the recall election to be elected for the remainder of the term.
