AL HB120

Requires all persons involved in accidents resulting in death or serious physical injury to submit to a blood test for alcohol and drug content, changing existing law that only deemed consent.

Authorizes law enforcement officers to take reasonable steps to obtain blood samples from involved persons when the officer has reasonable grounds to believe impairment occurred.

Prohibits persons from refusing to submit to the required blood test, unless a court order is obtained beforehand.

Provides immunity from civil and criminal liability for physicians, nurses, laboratory technicians, phlebotomists, hospitals, and other qualified health care providers who administer blood tests at law enforcement's direction.

Becomes effective on the first day of the third month following passage and approval by the Governor.
