HB134 Summary

• Requires Jefferson County Commission to submit quarterly accounting of collections and disbursement from the Indigent Health Care Fund to each Jefferson County Legislative Delegation member and the public on their website, beginning July 1, 2013.

• Requires yearly accounting of the Indigent Health Care Fund to be conducted by the Department of Examiners of Public Accounts.

• Imposes civil penalty of up to $250 per day for each day the quarterly accounting is not filed with legislative delegation members.

• Allows commissioners to appeal penalties within 30 days to Circuit Court in Jefferson County, and establishes that penalties are enforceable as debt owed to the Indigent Health Care Fund with liable commissioner paying all costs including court costs and attorney fees.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
