HB136 Summary

• Amends Section 18-1B-2 of the Code of Alabama 1975 to exempt property of less than one acre from the requirement to offer it to the former owner when selling condemned property.

• Conditioned property that is not used for its original public purpose and is subsequently determined to be sold must still be offered first to the former owner at the original purchase price, minus documented income and transaction taxes.

• Former owner has 90 days from the offer date to accept the resale offer; if rejected, the property may be sold to others only at public sale after legal notice.

• The exemption applies only to unused condemned property measuring less than one acre, allowing such parcels to be sold without first offering them to the original owner.

• Effective date is the first day of the third month following passage and gubernatorial approval.
