HB174 Summary

• Amends Alabama Code Sections 22-21-260, 22-21-263, and 22-21-270 to clarify that health care facilities and health maintenance organizations may be organized as limited liability companies and other legal entities.

• Specifies that transfers of certificates of need (CON) by sale, lease, or other transaction involving existing health care facilities, health maintenance organizations, or institutional health services do not require new or additional CON approval.

• Exempts expenditures incurred in the sale, lease, or transfer of existing health care facilities or institutional health services from certificate of need subdivision requirements.

• Applies retroactively to July 30, 1979, clarifying the treatment of transfers previously permitted under earlier amendments to CON law.

• Becomes effective immediately upon passage and approval by the Governor.
