HB 208 Summary

• Authorizes law enforcement officers to arrest a person without a warrant when they have reasonable cause to believe the person has committed trespass on the premises of an educational institution.

• Expands the definition of "building" under Alabama Code Section 13A-7-1 to include any structure used for any purpose by an educational institution.

• Defines "educational institution" as a public or private college, university, graduate school, professional school, junior college, trade school, elementary school, secondary school, and institutions for education and training of the deaf, blind, or individuals with developmental disabilities.

• Adds trespass on educational institution premises as a new warrantless arrest provision under Alabama Code Section 15-10-3(a)(9).

• Becomes effective immediately upon passage and approval by the Governor.
