HB214 Summary

• Amends Sections 30-3-61, 30-3-62, 30-3-65, and 30-3-66 of the Code of Alabama 1975 relating to child support withholding orders by removing provisions that allowed support payments to be made to the clerk of the court.

• Requires employers who receive income withholding orders for payment of child support arrears under Title IV-D of the Social Security Act to notify the Department of Human Resources at least 45 days prior to releasing payments of $500 or more to the obligor.

• Prohibits employers from releasing arrears payments to the obligor until 30 days after the intended payment date or until receiving authorization from the department, whichever occurs first.

• Changes references in withholding order provisions to direct payments to the Department of Human Resources or its designee rather than to court clerks as the appropriate collecting entity.

• Becomes effective immediately upon passage and approval by the Governor.
