HB231 Summary

• Amends Alabama's Good Samaritan Law (Section 6-5-332) to add civil immunity protections for entities or individuals providing access to safe shelter during severe weather.

• Defines "safe place" as any property, dwelling, shelter, or structure that reasonably provides protection from severe weather including tornadoes, hurricanes, high winds, and floods.

• Protects shelter providers from civil liability if acting in good faith and if damage or injury was not caused by willful or wanton negligence or misconduct of the provider.

• Requires that providers act as a reasonably prudent person would under the same or similar circumstances to qualify for immunity.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
