HB24 Summary

• Increases the age requirement for mandatory personal flotation device (life jacket) use on vessels in state waters from under 8 years to under 13 years of age.

• Requires all persons under 13 years of age on any vessel or boat to wear a United States Coast Guard approved wearable personal flotation device of proper size, except when inside an enclosed cabin or sleeping space.

• Personal flotation devices must be strapped, snapped, or zippered securely and maintained in good condition at all times they are required to be worn.

• Violation is a Class B misdemeanor with a mandatory minimum fine of $100; applies to any person who fails to require or permits a child under their legal custody or control to fail to comply.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
