Professional bail companies must submit a sworn affidavit to the court clerk detailing the defendant's violations before obtaining a certified copy of the bail undertaking.

False statements in the sworn affidavit constitute perjury in the third degree under Section 13A-10-103.

Only employees, agents, or persons with a financial interest in the professional bail company who made or are listed on required certifications may arrest a defendant using a certified copy of the undertaking.

A $50 fee is assessed for each certified copy of the undertaking, distributed annually as: 10% to the county Sheriff's Fund, 45% to the circuit clerk's fund, and 45% to the Solicitor's Fund in the county where certification was filed.

The bill becomes effective on the first day of the third month following passage and approval by the Governor.
