HB401 Summary

• Amends Sections 31-12-5 and 31-12-6 of the Code of Alabama 1975 to extend salary differential compensation to state employees, public education employees, and local government employees called into active military service in the Armed Forces of the United States.

• Removes the limitation restricting compensation to only those called into service "during the war on terrorism which commenced in September 2001," making the benefit available for any active duty military service.

• Provides compensation equal to the difference between lower active duty military pay and higher public salary the employee would have received if not called to service, paid for the duration of active military service as determined by the Alabama National Guard Adjutant General.

• For local government employees, allows governing bodies to determine the payment period under local rules and regulations, rather than mandating payments as required for state and public education employees.

• Becomes effective immediately upon passage and approval by the Governor.
