HB44 Summary

• Adds new Section 30-3-69.1 to Alabama Code Title 30, Chapter 3, Article 3 to address employer conduct related to child support withholding.

• Makes an employer personally liable for child support owed if the employer intentionally pays an employee's wages in a manner designed to protect those wages from garnishment or withholding for child support collection.

• Establishes that an employer's personal liability extends to the full amount of child support that could have been withheld, treating the employer the same as one who willfully fails or refuses to comply with withholding requirements.

• Takes effect on the first day of the third month following passage and approval by the Governor, or when otherwise becoming law.
