Montgomery County Commission may contract with private, public, or governmental entities for service of process, except for service of arrest warrants, with the sheriff's concurrence.

Imposes an additional $30 service of process fee per document for both civil and criminal divisions of district and circuit courts in Montgomery County.

Court-designated officials shall collect fees and remit them to Montgomery County Commission for deposit in the county general fund.

Fee may be waived if court finds payment creates substantial hardship, requiring a verified statement from the requesting person approved by the court.

District attorney, law enforcement, and grand juries are exempt from payment of the fees.

Act becomes effective on the first day of the third month following passage and approval by the Governor.
