Municipal judges and magistrates in Birmingham can assess defendants a $100 warrant recall fee to recall failure to appear warrants issued for municipal ordinance violations.

The warrant recall fee must be paid by the defendant at the time the warrant is recalled.

Recall of warrants is entirely discretionary with the municipal judge or magistrate; the City of Birmingham has no obligation to recall any warrant.

All warrant recall fees collected by Birmingham Municipal Court shall be deposited into the City of Birmingham Corrections Funds and allocated according to Alabama Code Section 11-47-7.1(a).

The act becomes effective immediately upon passage and approval by the Governor or upon otherwise becoming law.
