Amends Act 2006-360 to modify how recording fees are handled in Russell County's probate office.

Establishes a $5 recording fee payable to the county and collected by the judge of probate for each instrument filed for record and each marriage license issued.

Requires all collected recording fees to be deposited into a bank or financial institution account within Russell County, maintained and managed by the judge of probate, rather than the county depository.

Designates accumulated fees to be used at the judge of probate's discretion for modernizing probate office records and record-keeping, and prohibits use for general probate office operations unless declared excess by the judge.

Takes effect on the first day of the third month following passage and approval by the Governor.
