• Amends Section 45-29-83.47 of the Alabama Code to establish a special recording and indexing fee of $5 collected by the judge of probate in Fayette County.

• The $5 fee applies to cases filed in probate court, real property instruments, personal property instruments, incorporations, notary bonds, name changes, and marriage licenses issued or ceremonies performed by the judge of probate.

• No case, filing, or marriage service can be processed unless the special recording and indexing fee is paid, in addition to all other required fees and charges.

• Collected fees must be deposited in a Fayette County bank and spent at the judge's discretion for improved recording and indexing systems, equipment purchases, facility improvements, personnel, and probate office operations.

• All fees collected are subject to audit by the Department of Examiners of Public Accounts; the act becomes effective on the first day of the third month following passage and approval.
