HB85 Summary

• Prohibits more than one unrelated criminal sex offender from residing at the same residence.

• Requires a minimum distance of 500 feet between residences of different criminal sex offenders.

• Property owners or lessees who knowingly permit violations face misdemeanor charges, up to 90 days in jail, and fines up to $5,000 per violation; collected fines split equally between county sheriff's department and district attorney's office.

• Exempts sex offenders who are spouses or children of property owners/lessees, those providing signed statements of non-offender status, and those residing in state-approved treatment facilities or halfway houses.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
