HB86 Summary

• Amends Section 32-9A-2 of the Code of Alabama to require compliance with federal motor carrier safety regulations under 49 C.F.R. Part 107, Parts 171-180, Parts 382-384, 387, and Parts 390-399 as amended.

• Establishes specific requirements for load securement of metal coils in commercial motor vehicles, including operator certification standards published by the Department of Public Safety and compliance with 49 C.F.R. §393.120.

• Prohibits persons from operating commercial motor vehicles with improperly secured metal coils that could drop, fall, or escape onto public highways, and allows law enforcement to arrest or cite drivers without a warrant based on reasonable cause.

• Provides limited exemptions for utility service vehicles engaged in intrastate commerce and allows the Department of Public Safety to suspend or delay implementation of federal motor carrier safety regulations for up to three years for intrastate commerce vehicles.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
