SB151 Summary

• Amends Alabama Code Sections 22-21-260, 22-21-263, and 22-21-270 relating to certificate of need requirements for health care facilities and health maintenance organizations.

• Expands definition of "person" to include limited liability companies and other legal entities in addition to corporations, partnerships, and associations for purposes of organizing health care facilities.

• Clarifies that sales, leases, or transfers of existing health care facilities, health maintenance organizations, or institutional health services do not require certificate of need review unless the transaction involves implementing new institutional health services as defined in the statute.

• Establishes capital expenditure thresholds requiring certificate of need: $2 million (indexed for inflation) for major medical equipment, $800,000 for new annual operating costs, and $4 million (indexed for inflation) for other capital expenditures.

• Makes amendments retroactively effective to July 30, 1979, and takes effect immediately upon passage and approval by the Governor.
