SB194 Summary

• Amends Section 11-93-1 of the Code of Alabama 1975 to clarify that employees acting within the line and scope of their official duties are included in the definition of "governmental entity" for purposes of tort claims and judgments against local governmental entities.

• Adds new language to the "GOVERNMENTAL ENTITY" definition stating "The term shall also include any employee of the governmental entity as defined in subdivision (2)."

• Specifies in the "EMPLOYEE" definition that the term includes persons acting on behalf of any governmental entity in any official capacity within the line and scope of their employment or duties, whether temporary or permanent, with or without compensation.

• Clarifies that a claim against an employee acting within the line and scope of employment or duties is a claim against the employing governmental entity, not against the employee in a personal or individual capacity.

• Becomes effective immediately upon passage and approval by the Governor, and is declared to be declaratory of existing law.
