SB201 Summary

• Amends Alabama Code Section 25-4-78 to specify when an employer's unemployment compensation account may be charged for overpayments made to claimants, effective October 21, 2013.

• Employer accounts are charged for overpayments only when both conditions are met: (1) the overpayment occurred because the employer failed to respond timely or adequately to agency requests for information about the claim, AND (2) the employer has established a pattern of failing to respond timely or adequately on two or more occasions.

• Adds exception allowing employers to avoid charges if they establish they failed to respond due to information request failures, preserving existing protections for employers who respond appropriately to agency inquiries.

• Effective on the first day of the third month following passage and approval by the Governor.
