SB255 Summary

• Expands existing prohibitions on minors' tobacco use to include alternative nicotine products such as electronic cigarettes and products containing nicotine that can be ingested through chewing, smoking, absorbing, dissolving, or inhaling.

• Defines electronic cigarettes as electronic devices producing vapor that delivers nicotine or other substances to simulate smoking, excluding FDA-regulated drugs, devices, and combination products.

• Defines alternative nicotine products as non-tobacco items containing nicotine that can be ingested by various methods, with the same FDA exclusions applied.

• Makes it unlawful for any minor to purchase, use, possess, or transport tobacco, tobacco products, or alternative nicotine products within Alabama, with an exception for minor employees working within the scope of employment under direct supervision of a 21-year-old or older permit holder.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
