Prohibits licensed day care centers, child care facilities, day care programs for incapacitated persons, and persons for hire responsible for children under age 7 or incapacitated persons from leaving them unattended in a motor vehicle in a manner that creates unreasonable risk of injury or harm.

First violation results in a fine of not less than $2,000; second or subsequent violation is a Class C misdemeanor.

Physical injury to the child or incapacitated person elevates the offense to a Class A misdemeanor; serious physical injury elevates it to a Class C felony; fatal injury elevates it to a Class B felony.

Violations of this act cannot be considered evidence of contributory negligence and do not limit or mitigate insurance liability or existing causes of action.

The act becomes effective on the first day of the third month following passage and approval by the Governor.
