SB 275 Summary

• Amends Section 45-29-83.47 of the Code of Alabama 1975 to establish a special recording and indexing fee of five dollars ($5) collected by the judge of probate for Fayette County.

• Applies the $5 fee to cases filed in probate court, real property and personal property instruments, incorporations, notary bonds, name changes filed for record, and marriage licenses issued or ceremonies performed by the judge of probate.

• Prohibits filing of documents or performing services in the probate office unless the special recording and indexing fee is paid, with the fee being in addition to all other required fees and charges.

• Requires all collected fees to be deposited in a Fayette County bank and expended by the judge of probate for improved recording and indexing systems, equipment purchases, facility improvements, personnel, and probate office operations.

• Subjects collected fees to audit by the Department of Examiners of Public Accounts and makes the act effective on the first day of the third month following passage and approval by the Governor.
