SB 292 Summary

• Amends Section 40-17-224 of the Alabama Code to permit counties to use four-cent excise tax proceeds from gasoline and lubricating oil for vegetation management on county road rights-of-way.

• Defines vegetation management as actions to maintain road rights-of-way in safe condition through herbicides, bush hogging, and tree and limb removal.

• Allows county use of funds for either vegetation management or resurfacing, restoration, rehabilitation, and bridge replacement on county roads and bridges.

• Maintains existing restrictions that county funds cannot be used for equipment purchases or new construction unless 90 percent of the county's paved roads achieve a grade of 85 percent based on the Department of Transportation's annual maintenance report.

• Becomes effective on the first day of the third month following passage and Governor approval.
