SB 305 Summary

• Establishes the Alabama Behavior Analyst Licensing Board within the Division of Developmental Disabilities of the Alabama Department of Mental Health to regulate behavior analyst professionals.

• Creates two licensure categories: licensed behavior analysts (must be board certified by the Behavior Analyst Certification Board) and licensed assistant behavior analysts (must be board certified and maintain ongoing supervision).

• Board consists of seven members appointed by the Governor: four licensed behavior analysts, one licensed assistant behavior analyst, one parent/guardian of a child with behavior disorder, and one public member with no material interest in the profession.

• Prohibits unlicensed practice of behavior analysis with exceptions for licensed psychologists, graduate students under supervision, family members implementing home-based plans, and other licensed professionals outside the scope of behavior analysis.

• Licenses expire every two years and require renewal with proof of continued certification; board is subject to Alabama Sunset Law and automatically terminates October 1, 2016, and every four years thereafter unless reestablished by legislative action.
