SB309 Summary

• Amends Section 23-1-60 of the Code of Alabama 1975 to grant the Director of Transportation authority to approve additional, new, or extra work and work changes on highway projects without Governor approval when the increased amount does not exceed $100,000 or 10 percent of the initial contract amount, whichever is greater.

• Limits total aggregate increases to $200,000 per contract without requiring Governor approval, while allowing decreases or underruns to be authorized by the Director without Governor approval.

• Authorizes the Director to enter into supplemental contracts with prime contractors using agreed unit prices or lump sums without competitive bidding, or to direct extra work on a force account basis if unit prices cannot be agreed upon.

• Requires the Department of Transportation to develop procedures to implement the new authorization thresholds and processes.

• Becomes effective immediately upon passage and approval by the Governor.
