AL SB314

Allows the president of a municipal council to decline automatic succession to the office of mayor when a vacancy occurs in municipalities with 12,000 or more population governed by Section 11-43-42.

Requires the council president to file a written declaration with the municipal clerk within 72 hours of a vacancy to decline the mayor's office and remain on the council.

Authorizes the municipal council to fill a mayor vacancy from its own membership or from any qualified elector in the municipality when the council president declines succession.

Requires any person elected to fill the mayoral vacancy to be a qualified elector and meet all legal qualifications for the office of mayor.

Takes effect on the first day of the third month following passage and approval by the Governor.
