SB36 Summary

• Expands the crime of unlawful manufacture of a controlled substance in the first degree to include manufacturing or planning to manufacture on rental property such as apartments, rental houses, hotels, or motel rooms.

• Adds a new condition (item 8) to Section 13A-12-218 making criminal trespass on residential property or clandestine lab operations on rental property a qualifying aggravating factor for first-degree charges.

• Imposes an additional mandatory sentence of five years imprisonment without parole, probation, or suspended sentence for methamphetamine manufacture on rented property or residential property.

• Requires individuals convicted of operating clandestine drug laboratories to pay all reasonable costs associated with site remediation.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
