SB390 Summary

• Amends Section 35-8B-1 of the Alabama Code to address alcoholic beverage regulations when a community development district is annexed or incorporated as a municipality.

• Provides that if a municipality annexes a community development district, the annexed territory remains "wet" (permitting alcohol sales) regardless of the municipality's prior wet/dry status.

• Allows the governing body of a newly incorporated municipality that includes an entire community development district to discretionarily make the entire new municipality "wet" for alcohol sales purposes.

• Authorizes alcoholic beverage sales in the newly wet territory to the same extent allowed in any other wet municipality in the state.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
