AL SB42

Amends Section 16-64-4 of the Code of Alabama 1975 to permit two-year and four-year public institutions of higher education to set flexible tuition rates for nonresident online distance learning students.

Allows governing boards of four-year institutions to charge resident tuition rates, reduced rates, or rates determined by the board for nonresident students taking Internet-based courses.

Grants the State Board of Education authority, upon recommendation of the Chancellor of the Department of Postsecondary Education, to set flexible tuition rates for nonresident distance learning students at public two-year institutions.

Maintains existing requirement that nonresident undergraduate students pay a minimum of two times the resident tuition rate for traditional in-person enrollment.

Becomes effective on the first day of the third month following passage and approval by the Governor.
