SB431 Summary

• Amends Section 25-5-50 of the Alabama Code to remove the requirement that corporate officers file workers' compensation exemption certifications with the Department of Labor.

• Expands exemption eligibility to include members of limited liability companies, who may now elect annually to be exempt from workers' compensation coverage by filing written certification with their employer's insurance carrier only.

• Exempted corporate officers and LLC members may revoke their exemption and accept coverage by filing written certification with the employer's insurance carrier, with changes effective the first day of the calendar month following filing.

• Exemption elections do not relieve employers from continuing workers' compensation coverage for other eligible employees.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
